Terms of Service

1. Acceptance of Terms

Welcome to StealthCoach. These Terms of Service ("Terms") constitute a legally binding agreement between you and Wattan Corp ("we", "our", or "us") governing your access to and use of the StealthCoach mobile application (the "App"), including all content, features, and services offered through the App.

By downloading, installing, accessing, or using StealthCoach, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not download, install, or use the App.

2. Eligibility

StealthCoach is available to users of all ages. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you have the legal capacity to enter into this agreement.

3. Account Registration

To access certain features of the App, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential and not share it with any third party
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete, or if we reasonably believe your account has been compromised.

4. Description of Service

StealthCoach is an AI-powered sports coaching application that provides:

  • Real-time video analysis of your athletic form and technique using your device's camera
  • AI-generated coaching feedback, performance scores, and personalized drill recommendations
  • Voice interaction with the AI coach during live training sessions using your device's microphone
  • Session history, progress tracking, goal setting, and performance analytics

The App is designed to supplement, not replace, professional sports coaching and medical advice. AI-generated coaching feedback is provided for informational and educational purposes only.

5. Subscriptions and Payments

5.1 Subscription Plans

StealthCoach offers auto-renewable subscription plans that provide access to premium features. The specific features, pricing, and duration of each plan are displayed within the App at the time of purchase. Subscription prices are stated in U.S. dollars and may vary by region.

5.2 Billing and Renewal

All subscriptions are billed through Apple's App Store or Google Play Store, depending on your device platform. By subscribing, you authorize the applicable app store to charge your chosen payment method.

Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless you cancel at least 24 hours before the end of the current period. The renewal charge will be applied to your payment method within 24 hours before the end of the current billing period at the rate of your current subscription plan.

5.3 Free Trial

We may offer a free trial period for new subscribers. If you begin a free trial and do not cancel before it expires, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.4 Cancellation

You may cancel your subscription at any time through your device's app store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No partial refunds are provided for unused portions of a billing period.

5.5 Price Changes

We reserve the right to modify subscription pricing. Any price changes will take effect at the start of your next billing cycle following notice of the change. Your continued use of the App after a price change constitutes acceptance of the new pricing.

6. Acceptable Use

You agree not to use StealthCoach to:

  • Violate any applicable local, state, national, or international law or regulation
  • Record, upload, or transmit content that infringes on the intellectual property rights of any third party
  • Record or capture images of other individuals without their consent
  • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
  • Interfere with or disrupt the integrity or performance of the App or its servers
  • Use automated scripts, bots, or other means to access the App in a manner not authorized by us
  • Attempt to gain unauthorized access to any portion of the App or any systems or networks connected to the App
  • Use the App for any commercial purpose other than its intended use as a personal training tool
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate your access to the App if you violate any of these provisions.

7. Intellectual Property

The App, including all content, features, functionality, design, graphics, trademarks, service marks, logos, and the underlying software and technology, is owned by Wattan Corp and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your personal, non-commercial training purposes, subject to these Terms.

You retain ownership of any content you create or upload through the App (such as training videos and session notes). By using the App, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving the coaching services.

8. AI Coaching Disclaimer

The coaching feedback, technique analysis, scores, drill recommendations, and other guidance provided by the App are generated by artificial intelligence and are intended for informational and educational purposes only. This content does not constitute professional sports coaching, medical advice, physical therapy, or any other professional service.

You acknowledge and agree that:

  • AI-generated coaching is not a substitute for qualified, in-person coaching from a certified professional
  • You should consult a physician or qualified healthcare professional before beginning any new exercise program, especially if you have any pre-existing medical conditions or injuries
  • You assume all risk of injury associated with your training activities, whether or not you follow the App's suggestions
  • AI analysis may not always be accurate and should be used as one input among many in your training decisions

9. Privacy

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the practices described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED COACHING FEEDBACK.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Wattan Corp, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.

10.3 Assumption of Risk

You acknowledge that sports training involves inherent risks of physical injury. You voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of others, and assume full responsibility for your participation in any training activities.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wattan Corp and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you create, upload, or transmit through the App.

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by deleting your account through the App's settings. Upon account deletion, all your personal data will be permanently and irreversibly removed in accordance with our Privacy Policy.

Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Disclaimers and Limitation of Liability, Indemnification, and Governing Law.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you through the App or by other means.

Your continued use of StealthCoach after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association.

15. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Wattan Corp regarding the App and supersede all prior agreements.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
  • Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control.
